Terms and Conditions

I am Natálie Rumpala, a freelance social media manager, video maker and copywriter, with my registered office at Livornská 421, Prague, 109 00. I have been registered with the trade licensing office since 1 March 2016 under Company ID 04860403.

I am pleased that you are considering working with me. Whether it concerns managing your social media profiles, consultations, video production, writing or editing your texts, or workshops, our contractual relationship will be governed by these terms.

Please note that I provide my services to companies and other professionals; they are therefore not intended for consumers.

1. Ordering my services

How do you order my services? Nothing complicated – just get in touch and we will agree on the details.

  1. You will find various types of cooperation on my website. If you are interested in any of my services, please contact me at info@rumpala.cz.

  2. Your enquiry about one of my services does not in itself create a contractual relationship between us. Once I receive your message, I will inform you about the details of the relevant service, especially my availability, its scope and the fee. Our contractual relationship will only arise once we have mutually agreed on the terms and course of the cooperation.

  3. For agreed services, I issue an advance invoice for up to 100% of the fee. The advance invoice is due within 10 days of issue. If the advance is not paid, I am not obliged to start working on the assignment and I am not in default. The advance is fully refundable if you cancel the order within 5 working days of payment of the advance invoice. After this period, the advance is non-refundable.

  4. If new matters arise during our cooperation that result in additional work, I will inform you in advance and tell you what increase in the fee to expect. If you do not agree to the increase, I will deliver the work without the additional work and remain entitled to payment for the work completed.

  5. My working hours are Monday to Friday, 9:00 to 16:00. Outside these hours, I am available by prior arrangement only.

  6. My working time is exclusively mine to allocate. If you are interested in additional work, you must agree it with me in writing and sufficiently in advance.

  7. In-person meetings must always be arranged at least 5 calendar days in advance. I charge CZK 1,500 per hour for in-person meetings, including the time required to travel to the meeting place.

  8. All analyses, posts, videos, texts and reports created for you become your property upon payment, and you may use them as you wish.

  9. For long-term cooperation, you may stop using my services at any time. We will simply complete the month that has already started or been prepared.

  10. I reserve the right to end our cooperation at any time during the engagement. We will simply complete the month that has already started or been prepared.

  11. I prefer communication by e-mail and respond within two working days. For personal productivity reasons, I process e-mails only once a day. If I have not replied within 3 working days, please contact me again – your e-mail has most likely gone astray.

  12. I will remind you about any request no more than three times.

  13. If I plan to be unavailable for more than three working days, I will inform you in advance. During my holiday (of which I will always inform you in advance), I am not available for the operational creation of posts, videos, texts, newsletters or campaigns.

2. Ordering a consultation

Sometimes you only need a consultation – in that case, we can arrange a one-off consultation.

  1. If you need advice on social media, want to check its settings or have me look over your posts, a consultation is the right choice for you. Contact me at info@rumpala.cz.

  2. We will agree on what you need to discuss during the consultation. I will then send you my offer, which includes the fee for preparation and for the consultation itself. If we approve the offer, we have concluded a contract governed by these terms.

  3. If you cannot attend a booked consultation and let me know at least 24 hours before the meeting, I will not charge a cancellation fee for the reserved time. If you cancel later, I charge a cancellation fee of 100% of the fee for the total reserved time and the preparation fee.

  4. If you no longer want the consultation at all and cancel it at least 24 hours before the meeting, I will refund your money.

  5. If the consultation does not take place because you do not attend without notice, your payment is forfeited.

  6. For agreed services, I issue an advance invoice for up to 100% of the fee. The advance invoice is due within 5 days of issue. If the advance is not paid, I am not obliged to provide the service. The advance is fully refundable if you cancel the order within 3 working days of payment of the advance invoice. After this period, the advance is non-refundable.

3. Payment terms

You can find the prices for my services and workshops on the website in the price list, or we can agree on them individually.

The following terms apply to all of them:

  1. I always issue an advance invoice for my services, for up to 100% of the fee. If an advance invoice is issued and not paid by its due date, I am not obliged to start working on the agreed service. Please note that late payment of the advance invoice changes the agreed delivery date because the originally reserved capacity may no longer be available.

  2. When paying for my services by bank transfer, please include the payment variable symbol.

  3. Once the fee has been paid, I will issue a regular invoice. I am not a VAT payer.

  4. I will send the invoice electronically to the e-mail address you provide.

  5. Payment gateway provider: Comgate, a.s. – https://www.comgate.cz/cz/platebni-brana. Card payments and bank payment buttons are available.

4. What if the services or consultations have a defect?

I always deliver services and consultations tailor-made and to the highest possible quality. However, even with every effort, a service may sometimes contain an error. What should you do in such a case?

  1. If you believe that a provided service, text, video or workshop has a defect (its scope or quality does not correspond to the agreed terms), you have the right to make a complaint in full accordance with the law, especially the Civil Code. Please note, however, that a complaint cannot be based on the fact that the service or consultation does not meet your subjective expectations.

  2. You can make a complaint by e-mail at info@rumpala.cz.

  3. Please include:

    • which service or consultation the defect concerns
    • your contact details, a description of the defect and your requested resolution
  4. I will get back to you as soon as possible with a proposed solution.

5. Copyright and personality rights

The materials and work outputs I create are very often protected by copyright. What may and may not you do with them?

  1. If you attend my workshop or consultation, you may use the materials I provide for your own educational purposes. Please understand, however, that they contain my know-how and are intended only for you, so I ask you not to distribute them further.

  2. For personality-rights reasons, workshops and consultations may not be recorded or otherwise captured without my express consent (and, where applicable, the consent of the other participants), even for personal use.

  3. If you have paid for my services and I provide you with tailor-made texts, videos or posts, I grant you the right to use the outputs without time, quantity or territorial limitation. You may have third parties use the texts and may modify them. You are not required to name me as the author.

  4. If you wish to register my text or video as a trademark, please contact me so that we can agree on it. My consent is required.

6. Personal data protection

I need to process some of your personal data in order to provide services or consultations.

  1. If you enquire about my services or consultations, I will work with the contact details you provide through the enquiry form or by e-mail. These may include your first and last name, business details, e-mail address, telephone number, your requirements concerning the service or workshop, and any other information you provide.

  2. I need to process this personal data to discuss and provide the agreed performance, for potential tax and accounting purposes and, where applicable, to demonstrate that I have fulfilled my obligations. Such processing is based on the GDPR grounds of contract performance, compliance with legal obligations and legitimate interest.

  3. I will process personal data for the duration of our cooperation and for a further 10 years after it ends.

  4. Who may access the personal data? These are:

    • SimpleShop service provider, Redbit s.r.o., Antonína Dvořáka 612, 280 02 Kolín II, Company ID 24197190
    • Google service provider, Google Ireland Ltd., Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland
  5. The GDPR gives you, among other things, the right to contact me and request information about which of your personal data I process, request access to this data and have it updated or corrected, or request a restriction of processing. You may request a copy of the personal data being processed, request its erasure in certain situations and, in certain cases, request its portability. You may object to processing based on legitimate interest. If you believe that I am not handling your data correctly, you have the right to lodge a complaint with the Office for Personal Data Protection or bring your claims before a court.

7. Final provisions

In conclusion:

  1. These terms and conditions are drawn up in Czech and are governed by Czech law.

  2. Please note that I may amend or supplement these terms and conditions, especially to the extent necessary due to changes in legislation.
